Client Update: Draft Policy with Respect to Contaminated Land Published for Public Input

HFN's Environmental & Climate Change department issued a client update regarding the Ministry of Environmental Protection's (MOEP) publication for public input on its draft policy with respect to contaminated land. The policy aims to set forth the circumstances when industrial and other parties are obligated to perform ground surveys and ground remediation work. The policy has substantive potential impact on all parties involved in the industrial and real estate sectors.

Among other things, the draft policy provides mandatory Phase I land survey performance for a industrial facilities every 7 years and an obligation to take measures to mitigate potential risk from any contamination discovered in a survey. It also provides for a quantitative threshold of hazardous substance release that will trigger a notification requirement to MOEP.
