HFN Awarded Ground Breaking Supreme Court Decision

HFN has successfully overturned a decision by the Tel-Aviv District Court which stated that a distributor of TV smart cards is liable for the infringement of copyrights for allowing Israeli viewers to watch the 2006 FIFA World Cup tournament on foreign television channels and not via the proclaimed exclusive licensee.

The Supreme Court overturned this decision and ruled, inter-alia, in a ground breaking decision, that under Israeli copyright law, "by-passing" the rights of copyright owners by using technological equipment does not constitute copyright infringement (C.A. 5097/11 Telran vs. Charlton).

The HFN team was led by Litigation and Dispute Resolution partner Gilad Wekselman, Racheli Pery-Reichman and Gilad Shay from the IP department.
